Saivel Marketing & Automation LLC is a Washington State limited liability company. We provide marketing automation products, solutions, and services for businesses across multiple industries. Our current solutions include the Church Growth Kit, which provides automation and engagement tools for churches and ministries, and Notary Automation, which provides automation solutions for notary businesses. Additional products and industry-specific solutions may be offered in the future.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in violation of applicable law;
• Attempt to gain unauthorized access to the Site, related systems, or networks;
• Interfere with the security, integrity, or operation of the Site;
• Transmit harmful, fraudulent, abusive, or unlawful material;
• Impersonate another person or entity or misrepresent your affiliation with another person or entity.

Saivel offers marketing automation products, solutions, and services as described on the Site. Product features, pricing, availability, scope, implementation requirements, and service terms may vary by product and may be governed by separate order forms, service agreements, proposals, or other written agreements.

If a separate written agreement between you and Saivel conflicts with these website Terms regarding a particular purchased service, the separate written agreement will control for that service.

Pricing, payment schedules, cancellation terms, refund terms, and other financial obligations for purchased products or services will be disclosed in the applicable checkout page, order form, proposal, service agreement, or other purchase documentation.

These Terms do not create a separate refund or cancellation right beyond the terms expressly provided with the applicable product or service.

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. SAIVEL MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

Nothing in these Terms limits any warranty or right that cannot lawfully be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAIVEL MARKETING & AUTOMATION LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE.

Any limitations applicable to a purchased Saivel product or service may also be stated in the separate agreement governing that product or service.

Saivel Marketing & Automation LLC may communicate with you by SMS or text message if you have opted in.

• Types of Messages: Messages may include responses to inquiries, appointment reminders, service or account updates, follow-up communications, and, when you have separately consented, marketing and promotional information about Saivel products and services.
• Message Frequency: Message frequency may vary.
• Message and Data Rates: Message and data rates may apply.
• Opt Out: Reply STOP to opt out of SMS messages.

• Voluntary Participation: Participation in SMS messaging is voluntary.
• Not a Condition of Purchase: Consent to receive marketing text messages is not a condition of purchasing any product or service from Saivel.
• Privacy: Mobile information and text-message opt-in data and consent will be handled in accordance with our Privacy Policy and will not be shared with third parties or affiliates for their own marketing or promotional purposes.
• Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission by the user’s wireless service provider and network availability.
• Age Requirement: You must be at least 18 years old to opt in to or participate in Saivel Marketing & Automation LLC’s SMS messaging program.

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any legal action arising from these Terms will be subject to the jurisdiction of the appropriate state or federal courts located in Washington State, except where applicable law requires otherwise.
